EU Data Act Notice

We strive to ensure that any data generated by our connected products and related services is used fairly, lawfully, and securely. Compliance with EU Regulation 2023/2854 (the "EU Data Act") is our top priority.
These documents provide information for users regarding data that may be generated by the products we sell and our related services.
These documents must be read in conjunction with, and are without prejudice to, the applicable Terms and Conditions of Use and Privacy Policy. With respect to personal data, the Privacy Policy shall prevail over these documents.

Provision of Information on Product Data

Mimaki Engineering Co., Ltd. (the “Company”, “us” or “our”) provides the following information relating to Product Data concerning our printers and cutting plotters (the “Devices”).

1. Types, Formats and Estimated Volume of Product Data

・ Type: Operational status data of the Devices (such as status, remaining ink level, printing progress, machine name, serial number (S/N), and error status), historical data (such as printing results (conditions, ink consumption, time, job ID/name), maintenance history, and ink replacement history), running data (such as number of maintenance operations, number of head shots, and UV irradiation time), and operational logs/parameter data of the Devices.

・ Format: CSV format

・ Estimated Volume: Approximately 2.5 MB per day

2. Frequency of Product Data Generation

When the Devices are registered with “Mimaki Cloud Technology PICT” (“PICT”), the following data is continuously generated in the cloud while the devices remain connected to the cloud.

  1. (a) Status Data: The operational status of the device is checked every minute, and if any change is detected, data is generated in the cloud. Even if no change is detected, the data is still generated every five minutes.
  2. (b) Historical Data: Generated every hour.
  3. (c) Running Meter Data: Generated once per day.

3. Storage Location of Product Data

Product Data may be temporarily stored on the flash memory within the Devices, and may only be stored on the device to that extent. However, when using PICT, Product Data may also be stored on the PC on which “PICT Up” is operated, as well as on the cloud service provided by the Company, and may therefore also be stored on remote servers.

4. Methods for Access, Retrieval or Erasure of Product Data

By logging into the PICT Dashboard site, users can display the current operating status and history and can access Product Data. By downloading the historical data from the device page, users can retrieve Product Data in CSV format. To erase the user’s Product Data stored in the cloud, it is necessary to delete the organizational account registered with PICT.

Provision of Information Relating to Data Concerning Related Services

Mimaki Engineering Co., Ltd. (the “Company”, “us” or “our”) provides the following information relating to Product Data concerning our printers and cutting plotters (the “Devices”).

1. Types, Formats and Estimated Volume of Product Data

・ Nature: Operating status of the Devices, historical information, running data, and operation logs/parameters.

・ Estimated Volume: Approximately 2.5 MB per day

・ Frequency of Collection: Every one or five minutes / every hour / once per day

・ Conditions for Access, Retrieval and Storage: By logging into the PICT Dashboard site, users can display the current operating status and history and can access Product Data. By downloading the historical data from the device page, users can retrieve Product Data in CSV format. In addition, the Company will retain the Product Data for three months after the date on which the Service ends.

2. Basic Information and Conditions for Use of Related Service Data

・ Nature: Operating status of the Devices, historical information, running data, and operation logs/parameters.

・ Estimated Volume: Approximately 2.5 MB per day

・ Conditions for Access, Retrieval and Storage: By logging into the PICT Dashboard site, users can display the current operating status and history and can access Product Data. By downloading the historical data from the device page, users can retrieve Product Data in CSV format. In addition, the Company will retain the Related Service Data for three months after the date on which the Service ends.

3. Use of Data by Data Holder and Disclosure to Third Parties

・ Nature: Operating status of the Devices, historical information, running data, and operation logs/parameters.

  1. (a) provision and improvement of the Service;
  2. (b) maintenance and troubleshooting support for members’ printers; and
  3. (c) marketing activities for our products.

・ Disclosure of Data to Third Parties: The Company may provide data to our subsidiaries, service contractors, and distributors of the Devices, who are subject to confidentiality obligations, for the purpose of providing the Service.

7. Right to Lodge a Complaint

Users of the Service have the right to lodge a complaint with the designated competent authority pursuant to Article 37 of the EU Data Act, if there is a violation of Chapter II of the EU Data Act in connection with the Service.

8. Existence of Trade Secrets and Basic Information of Their Holders

The Company is the holder of the trade secrets with respect to the data relating to the Service.

9. Contract Term and Termination Conditions

The term of the Service begins when the user agrees to the Terms of Use for “Mimaki Cloud Technology PICT” (see here) and continues until the Service is terminated by either the Company or the user. The conditions for termination of the Service are as provided in the said Terms of Use.
